GP FOR HOME The Court made the following: 2 ORDER : This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “.... to issue a writ, order or direction more particularly one in the nature of a writ mandamus declaring the high handed action on the part of the respondent No.3 in interfering with the affairs of the BalijaTelagakapu Annadana Samajam, (Regd.No.348 of 1995) Penchalakona, Rapur Mandal, SPSR Nellore District at the instance of respondent No.4 even though the Registrar of Societies, Nellore has acknowledged the Committee vide its number 39 of 2024 and pressurizing to handover the administration of the Ananadana Samajam to the respondent No.4 as arbitrary, illegal, Colorble exercise of power, apart from being voilative of fundamental rights guaranteed to the petitioner under Articles 14, 19 and 21 of the Constitution of India and consequently direct the respondent No.3 not to interfere with the affairs of the BalijaTelagakapu Annad ana Samajam )Regd. No.348 of 1995) Penchalakona RapurMandal SPSR Nellore District and not to pressurize me o handover the administration of the BalijaTelagakapu Annadana Samajam (Regd No.348 of 1995) Penchalakona, Rapur Mandal, SPSR Nellore District to the respondent No.4…...” 2. Heard the learned counsel for the petitioner, learned Government Pleader for Home appearing for respondent Nos.1 to 3. 3. Today, when the matter came up for hearing, learned Government Pleader for Home furnished a copy of the instructions of the Sub-Inspector of Police, Rapur Police Station, SPSR Nellore District, wherein it is stated that as per the records of respondent No.3, there has been no representation from the petitioner or against the petitioner. After receipt of the present writ petition, the 3rd respondent, on enquiry, came to know that the petitioner’s group and 3 other groups are having civil disputes regarding the Balija Telaga Kapu Annadana Samajam (Regd.No.348 of 1995), Penchalakona, Rapur Mandal, SPSR Nellore District. As the matter is purely related to the civil issues, the respondent police never interfered with the civil issues pending between the petitioner and the other groups. 4. Recording the same, the Writ Petition is disposed of directing the respondent police are directed not to interfere with the civil disputes between the petitioner and other groups until and unless there is a specific direction from the competent Civil Court.
