2. Instant petition has been filed seeking following reliefs:-
“(i)That the respondent/department may kindly be directed to release the amount qua encashment of unutilised earned leaves due (233 days) in the account of petitioner alongwith 18% interest. (ii)Any other relief that this Hon’ble Court deems fit, including the costs of filing this Petition, in the interest of justice, equity and good conscience.”
3. The petitioner submits that the matter relates to leave encashment which is required to be given to the petitioner.
4. Learned counsel appearing for all the respondents submits that so far as leave encashment is concerned, it is not in dispute that it is required to be given but the service book and other documents relating to the petitioner has been sent for approval before the Joint Director, Chhattisgarh State Audit Department, Raipur, as such, after audit and after approval, it can be granted to the petitioner.
5. Considering the memo dated 17/12/2024 placed before me by respondents No.2 & 3, all the respondents are directed to consider the case of the petitioner for grant leave encashment which he is entitled for in accordance with law within a period of four weeks.
6. With these observations, the petition stands disposed of. Sd/-
