1. This first transit/anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who are apprehending their arrest in connection with Crime No.11191011250184/2025 registered at Police Station – E.O.W., Crime Branch, Ahmedabad City Crime Branch, Gujarat, for the offence punishable under Section 406 of the Indian Penal Code. 2. Prosecution case in brief, is that on 24.07.2025, the applicant was served with a notice under Section 179 of the B.N.S.S. by the Police Inspector, Prosecution and Crime Branch, E.O.W., Ahmedabad. In compliance with the said notice, the applicant travelled to Ahmedabad and furnished the information sought by the police. However, on 01.09.2025, the Police Inspector once again issued a notice to the applicant under Section 179 of the B.N.S.S. The applicant is willing to appear before the Police Inspector and respond to the notice, but there is a fear of being arrested by the Police Inspector. Therefore, the applicant has filed a Transit Anticipatory Bail Application before the Learned District Judge on 16.09.2025 (Annexure A/1). Hence, this application for Anticipatory/Transit Bail is being preferred. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the offence in question. It is further submitted that the applicant received a summons from the Police Inspector, E.O.W., Crime Branch, Ahmedabad City Crime Branch, Gujarat, dated 24.07.2025, directing him to appear for the purpose of interrogation. The applicant had previously appeared before the said authority, where his statement was recorded. However, the applicant now apprehends arrest by the concerned authority, particularly in light of the fact that his brother, who was also summoned for investigation, has been arrested and is currently in judicial custody. In view of the above circumstances, the applicant has approached this Court seeking grant of transit/anticipatory bail
3 for a limited period, especially after his bail application was rejected by the Court of the Sessions Judge, Durg. 4. I have heard learned counsel for the applicant and perused the material available on record. 5. After perusing the documents filed along with this application, and considering the nature and gravity of the offence as well as the aforesaid facts and circumstances, this Court deems it appropriate to grant transit/anticipatory bail to the present applicant for a limited period.
The applicant shall appear before the concerned authority on
28.10.2025. Till then, he is granted transit/anticipatory bail. Thereafter, he is at liberty to take recourse to law before the Court of competent jurisdiction. 6. Accordingly, the instant transit/anticipatory bail is allowed. It is
directed that in the event of arrest of applicant in connection with the aforesaid offence, he shall be released on bail by the Officer arresting him on his executing a personal bond with one surety in the like sum to the satisfaction of the concerned Investigating Officer. This order shall remain effective till 28.10.2025.
