Petitioners are serving as Assistant Engineer in Uttarakhand Pey Jal Nigam. They filed this writ petition in 2017, seeking the following relief:- “(i) Issue a writ, order or direction in the nature of mandamus directing to the respondents to hold a regular DPC with immediate effect for promotion to the vacant post of Executive Engineer and consider the eligibility of only those who are eligible on 1st July, 2016 and thereafter implement the recommendation of the DPC without any delay with immediate effect by issuing the order of promotion into the selected candidates.” 5. According to the petitioners, out of 58 total posts of Executive Engineer, 10 were lying vacant during the selection year 2016-17, however, the Competent Authority had not taken any steps for supplying those vacancies by regular promotion, therefore, petitioners have sought a direction to the Competent Authority to hold DPC for 2025:UHC:7123-DB promotion to the post of Executive Engineer. 6. Right to be considered for promotion has been held to be a fundamental right. If there are sufficient number of vacancies on the post of Executive Engineer, then it is incumbent upon the Competent Authority to initiate promotion exercise. 7. We, therefore, dispose of the writ petition with direction to Managing Director, Uttarakhand Pey Jal Nigam to initiate promotion exercise for supplying the available vacancies on the post of Executive Engineer, if not already initiated, within three months from the date of production of certified copy before him.
