This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“.... a Writ of Mandamus in not taking action on the petitioners application for police protection Dt.22/01/2025 from 4th and 5th respondents by the respondent police and consequently direct the respondents to take action on the application made by the petitioners and provide protection to the petitioners from 4th and 5th respondents as per their application Dt.22-01-2024.”
2. Sri Md.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that, there are civil disputes between the Petitioner Nos.1 and 2 and Respondent No.4 and 5 herein. It is submitted that, having received amount from Respondent Nos.4 and 5, Petitioner Nos.1 and 2 had executed a nominal sale deed and also issued promissory notes, stamped papers and cheques in their favour. Leaned Assistant Government pleader would further submit that, when Respondent Nos.4 and 5 attempted to take possession of the property on the basis of the said sale deed, the Petitioners sought police assistant to prevent such an act.
Learned Asst.Govenrment Pleader would submit that the Police have not received any application on 22.01.2025 seeking police protection from the Petitioners. Learned Assistant Government Pleader would finally submit that the matter is purely of civil nature and the Police cannot interfere with the same. 3. Sri J.Ravi Kumar, learned counsel for the Petitioners would submit that the Court may pass appropriate orders. 3
4. Considering the submissions made, the Writ Petition is disposed of giving liberty to the Petitioners to work out their remedies before appropriate forum in accordance with law. There shall be no order as to costs.
