HON’BLE MR. JUSTICE SAMEER JAIN
Order 26/11/2025
1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-applicant. The accused-applicant was arrested in connection with FIR No.0358/2019 registered at Police Station Vijay Nagar District Ajmer for the offence(s) under Sections 420, 406 of IPC.
2.
Learned counsel for the applicant has submitted that the applicant is the sole bread earner of his family and has no criminal antecedents. It is submitted that the offence alleged is triable by a First Class Magistrate and that the charge-sheet has already been filed. It is also submitted that the alleged incident of forgery involving an amount of Rs.1.28 crores pertains to the year 2013, whereas the FIR was registered after an inordinate delay of seven years without specifically naming the applicant. It is submitted that the arrest of the applicant has taken place six years from the
[2025:RJ-JP:47976] (2 of 2) [CRLMB-13049/2025] date of registration of the FIR. It is further submitted that in any event, the case essentially arises out of a money dispute between the parties.
3. Per contra, learned Public Prosecutor and counsel for the complainant have strongly opposed the bail application. It is submitted that an offence involving fraud of Rs. 1.28 crores has taken place and there are specific recoveries from the bank account of the applicant, which was operated through a PAN- based bank account operated under the name of the applicant.
4. Considering the arguments advanced by the counsel for the parties, considering that the applicant is the sole bread earner of his family and has no criminal antecedents; charge-sheet has already been filed; that FIR was registered after a delay of seven years without specifically naming the applicant and looking to the overall facts and circumstances of the case and material on record but without commenting on merits/demerits of the case, this court is inclined to allow the bail application of the accused-applicant and enlarge him on bail.
5. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that accused-applicant Vikas S/o Govindraprasad @ Munna shall be enlarged on bail provided he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
