The petition/Appeal coming on for hearing, upon perusing the Petition and the grounds filed in support thereof and upon hearing the arguments of Sri Y L SIVA KALPANA REDDY Advocate for the Petitioner, PUBLIC PROSECUTOR (AP) for the Respondent and the Court made the following. The Criminal Petition, u/See.482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is filed on behalf of the petitioners/Al and A4 to grant anticipatory bail in connection with Crime No.375/2024 of Rajampet Police Station, Annamayya District. 2. A case has been registered against the petitioners and others for the offences punishable under Sections 115(2), 61 (2), 308(5), 351 (2), 79 read with 3(5), 318(4) B.N.S. 3. The case of the prosecution in brief is that: The defacto complainant submitted a report to police stating that prior to 23.12.2024, the pet-ltioners who are Al and A4 and some others of Nellore town cheated the defacto comp[ainant with a promise tO register two villas and two sites at Nellore town, by taking nearly six crores. When the defacto complainant and her husband asked the accused to register the villas and sites, all the accused threatened the defacto complainant and her husband with dire consequences and extorted gold black beads chain weighing about two tulas, on the point of knife, from the neck of the defacto compla'lnant and beat both of them with hands and legs. Hence the complaint. t-_- I 4. Heard. Perused the record. 5. A perusal of the material available on record goes to show that certain amount has been received from the defacto complainant and thereafter the property has not been registered in the name of the defacto complainant. ln connection with the same, the defacto complainant had filed civil suit vide o.s.No.32/2024 on the file of the vllI Additional District and sessions Judge, NeIIore. lt is represented by the learned counsel for the petitioners that counter cases have been registered as against the defacto complainant vI-de Cr.No.38/2024 dated 24.02.2024 for the offences under sections 417, 420 and 506 IPC. lt is further represented that subsequent to filing of this crI'minaI Petition, AI was arrested and remanded to judicial custody and prays to dismiss the same forA1. 6. Merely because certain amount was not repaid to the defacto comPIainant, there is any amount of ambigul'ty whether an offence under Section 308 BNS would be made out. Apart from the same, the other offences as alleged against the petl-tioners are punishable with seven yearsandlessthansevenyears. since civil suits have been Pending in between both the parties, this court is inclined to grant the Prayer Of the Petitioner/A4 for grant of anticipatory bal-I. *1}C _i E=- ffl''* 7. Accordingly, in the event Of his arrest With regard tO th'lS Crime, petitioner/A4 shall be released on bail On his executing a Personal bond for a sum of Rs.10,000/-(Rupees ten thousand Only), with two sureties each for the like sum to the satisfaction of the arresting pol®lce officials and also on condition that the petitioner shall make himself available for investigation as and when required and that he shall not cause any threat, inducement or promise to the prosecution witnesses. The petitioner shall appear before the concerned Station House officer, once in a week i.e. on every sunday between 10.00 a.m. and o5.00 p.m., till filing of the charge-sheet. 8.
