The applicants have preferred this Anticipatory Bail application under Section 482 of BNSS, 2023, apprehending their arrest in connection with Crime No. 07/2025, registered at Police Station – Sakti, District – Sakti (C.G.) for alleged commission of offence punishable under Sections 318(2), 318(4), 111(1) and 3(5) of the BNS, and Sections 6 and 10 of the Chhattisgarh Protection of Depositors (Interest) Act, 2005. 2. Learned State counsel raised a preliminary objection regarding the maintainability of the present anticipatory bail application, as the same is RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI 2 not maintainable in view of the provisions contained in Section 15 of the Chhattisgarh Protection of Depositors (Interest) Act, 2005, to which learned counsel for the applicant could not waive out the preliminary objection raised by learned State counsel. 3. I have heard learned counsel for the parties and perused the material available on record. 4. Learned counsel for the applicants could not waive out the preliminary objection raised by the learned State counsel, hence, the present anticipatory bail application of the applicants – Bhagwati Yadav and Jeevan Yadav, apprehending their arrest in connection with Crime No. 07/2025, registered at Police Station – Sakti, District – Sakti (C.G.) for alleged commission of offence punishable under Sections 318(2), 318(4), 111(1) and 3(5) of the BNS, and Sections 6 and 10 of the Chhattisgarh Protection of Depositors (Interest) Act, 2005, is dismissed as not maintainable, in view of Section 15 of the Chhattisgarh Protection of Depositors (Interest) Act, 2005.
