The petition coming on for hearing, upon perusing the Petition and memorandum of grounds of criminal petition and the order of the High Court dated 28.02.2025 made herein and upon hearing the arguments of M/s Nagendra Babu Paragati, Advocate for the Petitioner and Public Prosecutor for the Respondent, the Court made the following:
ORDER:
“Heard. Perused the record.
Learned counsel for the petitioner submits that the petitioner belongs to Tamilnadu State and while releasing him on bail, this Court directed him to appear before the Station House Officer concerned, once in a week i.e. on every Saturday between 10.00 am and 01.00 pm till filing of charge sheet and also the petitioner shall not go beyond the jurisdiction of Guntur district, Andhra Pradesh State, without leave of the trial Court and he shall make available his location through mobile phone by pairing it with the mobile phone of the Investigating Officer round the clock. As his family members are residing in Tamilnadu, he could not go and meet his family members due to this condition and prays to relax the conditions. Learned Assistant Public Prosecutor submits that the petitioner has been complying the condition imposed by this Court without any deviation but he fairly submitted that the petitioner belongs to Tamilnadu State and once the conditions were relaxed, it would become difficult for the respondent-State to secure his presence. Considering the submissions made by the learned counsel for the petitioner, the conditions imposed on the petitioner/AI herein vide orders in Crl.P.No.1845 of 2025 dated 28.02.2025, i.e., the petitioner shall appear before the Station House Officer concerned
once in a week i.e. on every Saturday between 10.00 am and 5.00 pm till filing of charge sheet and the petitioner shall not go beyond the jurisdiction of Guntur District, Andhra Pradesh State, without leave of the trial Court and he shall make available his location through mobile phone by pairing it with the mobile phone of the Investigating Officer round the clock, are hereby relaxed. But it is made clear that the petitioner shall attend before the Station House Officer concerned once in a month between 10.00 am and 5.00 pm, for a period of four (04) months.
