1. The present writ petition has been filed for following relief:-
“This is an application for issuance of an appropriate writ/s order/ s or direction/s in the nature of writ of Certiorari for quashing the order of State Transport Appellate Tribunal in T.R. No.12 of 2023 being order dated 16.08.2023 (Annexure-6) by which the Revision was dismissed on the ground of limitation and the consequent order.”
2. It appears that the petitioner has a permit being Permit No.SC-PSTS- 0048/21 (RNC) for plying vehicle on the route from Lurgumi to Ranchi. 3. The respondent No.4 has also applied for permit for the same route and that has been granted being permit No.SC-PSTS-0008/22(RNC) valid from 27.12.2022 to 26.12.2027. 4. Petitioner wants avoidance of competition and he has raised objection and his objection has been rejected. 5. The appellate authority has sustained the order of rejection. Thereafter a transport revision has been filed and the revisional authority has also rejected the revision on the ground that there was delay in filing of the revision. 6. I have perused the revisional order dated 16.08.2023 passed in T.R. No.12 of 2023. The revisional authority has taken all the factors into account and has recorded the finding that delay has not been properly explained. 7. Further, the present writ petition has been filed on 24.01.2025 while the revisional order is dated 16.08.2023. 8. Thus, there is delay and latches on the part of the petitioner. (2025:JHHC:20217)
