1. The petitioner has filed this writ petition on the following reliefs:
“10.1. That the Hon’ble Court may kindly be pleased to issue a writ/order/direction, directing the respondent no. 4 & 5 to remove the respondents no. 6 & 7 from the government land part of Khasra No. 799/1, as per the order and dispossession warrant issued by the respondent no. 4, withon stipulated time. 10.2 That, any other relief/order which may deem fit and just in the facts and circumstances of the case including award of the cost of the petition may be given.”
2. Learned counsel for the petitioner submits that the order has already been passed under Section 248 of C.G. Land Revenue Code, 1959 against the respondent no. 6 and 7 who have encroached the government land part of khasra no. 799/1 admeasuring area 31.104 hectares situated at Village- Sarva, P.H. No. 17, Tahsil- Kasdol, District- Balodabazar- Bhatapara (C.G.) which is recorded as grass land in revenue records.

3. Learned counsel for the State submits that as per Annexure P/5, Tehsildar has issued warrant against the respondent no. 6 and 7 to vacate the encroached area of the government land.
4. Heard learned counsel for the respective parties and perused the record with utmost circumspection.

Looking to the grievance raised by the petitioner and submissions made by the respective parties, it is crystal clear that Tehsildar has already initiated the proceedings against respondent no. 6 to 7 on 10.06.2025 as Tehsildar has already issued warrant to vacate the encroached area of the government land against respondent no. 6 to 7. therefore, there is no need to issue any direction to the Tehsildar. However, since the petitioner was the complainant in the case before the Tehsildar, therefore, petitioner is directed to file representation before the Tehsildar within 15 days from today and thereafter concerned Tehsildar shall decide the representation filed by the petitioner in accordance with law, rules and regulations after giving sufficient opportunity of hearing to respondent no. 6 and 7.
6. With the aforesaid observation/direction, the petition stands
disposed of.
7. It is made clear that this Court has not expressed any opinion with regard to the merits of the case. Sd/-
