Neutral Citation No. - 2025:AHC:89458-DB Court No. - 29 Case :- WRIT - C No. - 31658 of 2019 Petitioner :- M/S Jalakash Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- J.P. Pandey Counsel for Respondent :- C.S.C.,Sunil Kumar Misra,Vineet Pandey,Vivek Saran Hon'ble Ashwani Kumar Mishra,J. Hon'ble Praveen Kumar Giri,J. Pursuant to the orders passed on the previous occasion, an affidavit has been filed by the Additional Commissioner, Bareilly Division, Bareilly, stating that the claim of the petitioner has already been settled and the amount found due and payable has been released. Sri J.P. Pandey, learned counsel for the petitioner, states that the amount was due in 2016 but has now been paid under orders of the Court. It is alleged that the petitioner is entitled to interest on such delayed payment. The law is settled that interest is a necessary concomitant of the delayed release of the amount. In such view of the matter, we dispose of the matter with the direction to the Divisional Commissioner to examine the petitioner's claim in respect of payment of interest and an appropriate order would be passed keeping in view the provisions of the contract as well as the applicable policy for payment of interest. It goes without saying that the consequential action, in terms of such determination, shall be taken without unnecessary delay. Sri Vivek Saran has appeared for the respondent.
