Present appeal has been filed for setting aside the order dated 28.03.2023 passed by learned Additional Sessions Judge, Jind whereby appellant was directed to pay penalty of Rs.5,00,000/- under Section 446 Cr.P.C., which is the amount of surety bonds furnished by appellant for accused-Naveen @ Pinku who is an accused in FIR No. 235 dated 31.08.2018 under Sections 395, 397 of Indian Penal Code, 1860 and Section 25 of Arms Act, 1959, registered at Police Station, Julana, District Jind. (2) Learned counsel for the appellant submits that sole appellant is no more and even his legal representatives (LRs) are also not interested in pursuing the present appeal; hence, the same be disposed off as not pressed. (3) Disposed off accordingly. (4) However, it is clarified that in case any of the LRs of deceased- appellant feel aggrieved, he/she may move an application for revival of the appeal and the same shall be considered in accordance with law.
