1. This Writ Petition has filed under Article 227 of the Constitution of India and prayed for the following reliefs:-
“10.1 This Hon’ble Court may kindly be pleased to set-aside impugned order dated 14.08.2019 (Annexure P-1) and direct the trial Court to allow the application under Order 39 Rule 1 & 2 read with Section 151 of the CPC, in the interest of justice. 10.2 This Hon’ble Court may kindly be pleased to the Court below to decide the civil suit as early as possible in the interest of justice. 10.3 This Hon’ble Court may further be pleased to pass an appropriate order or issue writ as deemed fit under the facts and circumstances of the case.”
2. At the outset, learned counsel for the petitioners submits that this
3 Petition may be disposed of directing the concerned trial Court to expedite the trial within a stipulated time frame. He further submits that on 20.09.2024, 6 months’ time was granted and later on, a PUD was received for extension of time. He would further submit that now the case has reached the stage of evidence. 3. Counsel for the other side would not oppose the aforesaid prayer. 4.
Having heard the submissions of learned counsel for the parties, this Court finds it appropriate to direct the concerned trial Court to decide the case in an expeditious manner, preferably within a period of 4 months. Ordered accordingly. 5. With the aforesaid direction, this Petition is disposed of. 6. Meanwhile, no third party interest shall be created in respect of the suit property for a period of 4 months.
