The aforesaid petition has been filed by the original complainant seeking quashing of the proceeding under the POCSO Act, 2012.
Learned Addl PP raises a preliminary objection. He submits that the petition has been filed by the original Serial No. 03 Daily List 2026:MLHC:65
complainant, who is the brother of the prosecutrix and as such, is not maintainable.
In view of the statement and the objection raised by the learned Addl PP, learned counsel for the petitioner seeks leave to withdraw the petition with liberty to file a fresh petition on behalf of the accused.
Petition is, accordingly disposed of as withdrawn with liberty as prayed.
It is made clear that the petition has not been heard on merits and as such, all contentions of all the parties on merits are kept open.
