This Second Appeal was filed by the appellants/plaintiff under Section 100 of the Code of Civil Procedure, 1908 (for short, 'C.P.C.') against the Judgment and decree, dated 05.09.2003 passed in A.S.No.13 of 1999 on the file of learned V Additional District Judge-cum-Sessions Judge’s Court, Guntur, confirming the judgment and decree, dated 28.10.1998 passed in O.S.No.07 of 1997 on the file of learned Senior Civil Judge’s Court, Gurazala. Today, when the matter is taken up for hearing, the learned counsel for the appellants submits that upon contacting the learned counsel who represented the appellants in the trial court, she was informed that the delivery 2. I proceedings had already been concluded. In view of the above information, learned counsel contends that the appeal has become infructuous. Considering the submissions made on behalf of both sides, the Second Appeal is dismissed as infructuous. However, there shall be no order as to costs. 3.
