Heard Sri R.H. Angadi, learned counsel for petitioner and Smt. Girija S. Hiremath, learned High Court Government Pleader for respondent.
2. Petition is filed under Section 483 of Bharatiya Nagarika Suraksha Sanhita, 2023, with the following prayer:
“To allow the petition and enlarge the petitioner on bail who is arrayed as accused No.9, in S.C.No. 33/2021, pending on the file Principal District and Sessions Judge Koppal, in connection with Bevoor P.S. Crime No. 78/2020, for the offences punishable under Sections 457, 458, 380, 382, 201 of IPC and Section 25(1A) of Indian Arms Act.”
2. The accused has been charge sheeted for offences punishable under Sections 457, 458, 380, 382,

201 of IPC and Section 25(1A) of Indian Arms Act. There is a common recovery from accused Nos.1, 9 and 10. Accused No.10 has been granted bail by the learned trial Judge, taking note of the gravity of the situation and also noting that there is no criminal antecedents insofar as accused No.10 is concerned. Accused No.9 also stands on the same footing.
3. Seven witnesses have already been examined before the trial Court. However, the bail application filed by accused No.9 came to be rejected by the in-charge judge.
4. Taking note of the fact that accused No.9 stands on the same footing that of accused No.10, who has been granted bail by the learned trial Judge himself, it is just and necessary to allow the bail petition of the present petitioner who is accused No.9, solely on the ground of parity.
3. Accordingly, following order is passed.

ORDER (i) The criminal petition is allowed. (ii) The Petitioner shall be enlarged on bail on executing a personal bond in a sum of Rs.1,00,000/- [Rupees One Lakh only] with two local sureties for the likesum to the satisfaction of the learned Trial Court. (iii) The petitioner shall not tamper the prosecution witnesses in any manner. (iv) Petitioner shall attend the Court regularly. (v) The petitioner shall not indulge in similar offences.
Violation of any of the above conditions, would entitle the prosecution to seek for cancellation of bail. Ordered accordingly.
