1. Heard Sri Virendra Kumar Shukla, learned counsel for the petitioner and learned Standing Counsel for the State. 2. By means of this petition filed under Article 226 of Constitution of India, the petitioner who is a widow of late Mahendra Nath Singh @ Mahendra Pratap Singh, an ex-collection ameen working under respondent nos.2 and 3 has approached this Court for a writ of mandamus to command the respondents to review their order dated 10.12.2005 whereby services of the petitioner were dispensed with on account of conviction in criminal case by the Trial Judge, however the said decision of his removal from service was subject to final outcome of the pending criminal appeal. The operative portion of the order dated 10.12.2005 passed by the District Magistrate, Jaunpur who is competent authority in the matter is reproduced hereunder:

3. Learned counsel for the petitioners contended that in the criminal appeal filed before this Court being Criminal Appeal No.2134 of 1986, the charged employee stood acquitted vide judgment and order dated 07.01.2025. Relevant portion of the order passed in criminal appeal is reproduced hereunder:
"10. The appeal accordingly stands allowed. The impugned judgment and order of the trial court dated 07.08.1986 convicting and sentencing the appellant is hereby set aside and the appellant is acquitted of the charges levelled against him. The accused-appellant Rajpal is on bail.
His personal bond is cancelled and sureties are discharged. 11. Appeal is allowed in above terms. 12. Copy of this judgment be sent to the court concerned for necessary compliance. "
4. Learned counsel for the petitioner submits that unfortunately the husband of the petitioner passed away on 16.11.2020 itself and so he died while the
order removing him from service was still there in existence. Thus it is contended now that since the petitioner's husband has stood acquitted, the order of removal from service also should be recalled and the family of the deceased employee should be held entitled to not only the arrears of salary for the period he would have continued in service but also the pensionary benefits and other consequential benefits as well.
5. Learned Standing Counsel for the State submits that the petitioner may be directed to approach the authority concerned who shall take decision in the matter in the light of acquittal granted to the husband of the petitioner no.1 by judgment of this
Court.
6. In view of the above, this petition stands
disposed of with direction to the petitioner to approach the District Magistrate concerned by writing an application alongwith certified copy of this
order and the District Magistrate after due verification of the judgment passed in said criminal appeal will proceed to consider recall of the order dated 10.12.2005 with all consequential benefits to the petitioners.
7. Appropriate decision shall be taken by the competent respondent authority within a period of two months of production of certified copy of this
order.
