Grant any other relief in the nature of writ as this Hon’ble Court feels just and proper in the facts and circumstances of the case. 4. A joint memo has been filed in WP No.105419 of 2024, which reads as under: “The parties herein most respectfully submits as under: 1. That the writ petition is filed challenging the order passed by Respondent No.1- Deputy Commissioner, Koppal reversing the order passed by the Respondent -Assistant Commissioner, only on the bases of the pendency of the RSA No. 101473/2022, which was filed by Respondent No. 12. 2. That the said RSA No. 101473/2022 field by the Respondent No. 12 has been withdraw on 13-11- 2024 in view of settlement entered between the Respondent No. 12 and Petitioner No. 1 herein as mentioned in the agreement produced along with this joint memo. 3. That insofar the present petition is concerned, the Respondent No. 4 who had challenged the order of Respondent No. 2 Assistant Commissioner, has also entered into agreement with the Petitioner No. 1 as per the agreement produced along with this memo. The same may kindly be treated as part of this memo. 4. That as per the terms agreed upon, in land bearing RS. No. 9/11 situated at Kustagi Dist: Koppal admeasuring 02 acre 06, Petitioner No. 1 is entitled to get title in respect of 1 acre 03 guntas. Petitioner No. 2 is entitled to get the title in respect of 1 acre. Respondent No. 4 is entitled for title in respect of 02 guntas. The submission of Sri C.S.Shettar., learned counsel for the respondents No.4 and 9, who were the Revision Petitioner and respondent No.3A in Revision Petition No.50/2023-24, is that he would be withdrawing the said Revision Petition. His submission is taken on record, due to the withdrawal of the Revision Petition the order passed therein would no longer be applicable or be in force. 6. A joint memo has been filed in WP No.101453 of 2025, which reads as under: “The Petitioner and Respondent No. 1 herein most respectfully submit as under: 1. That the writ petition is filed challenging the compromise decree passed in RA No. 50/ 2015 by the Lok Adalat before Senior Civil Judge Court at Kustagi vide ANNEXURE - A. 2. That the appeal was dismissed against this Petitioner. Since rights over immovable property to the extent of 01 gunta 05 ana are involved, Petitioner has now filed this petition. Respondent - 13 - NC: 2025:KHC-D:4060 WP No. 105419 of 2024 C/W WP No. 101453 of 2025 WP No. 101513 of 2025 No. 1 has also filed another writ in WP No. 105419/2024 (KLR-RR/SUR). Pending petition, the parties have entered into an agreement which is also produced along with the joint memo filed in said petition. 3. That as per the terms agreed under the agreement as well as this joint memo, Respondent No. 1 has agreed to give 01 gunta 05 ana of land in Sy. No. 9/11 having boundaries as mentioned in the agreement. The same may kindly be treated as part of this memo. 4. That in view the settlement, in land bearing RS. No. 9/11 admeasuring 02 acre 06 guntas situate at Kustagi,this Petitioner - Channabasayya Siddayya Hiremath is entitled for 01 gunta 05 ana. Petitioner in WP No. 101513/2025- Neelagangamma W/o. Gurappa Sunkad is entitled to get 02 guntas of land. Respondent No. 1 - Veerayya Panchayya Patrimathis entitled to retain remaining land to the extent of 01 acre 02 gunta 11 ana. Lohit Adappa Ballolli (Petitioner No. 2 in WP No. 1054189/2025) is entitled for 01 acre. Hence this petition may kindly be disposed off in terms of this settlement.” 7. Another joint memo has been filed in WP No.101513 of 2025, which reads as under: “The Petitioner and Respondent No. 1 herein most respectfully submit as under: 1. The joint memos are in terms of the submissions made by all the counsels. The petitioners in both the matters and respondent No.1, who is common in both the matters, are present before this Court. Consequently, the order dated 29.08.2024 is set-aside. ii) Writ Petition Nos.101453/2025 and 101513/2025 are partly allowed, the compromise decree dated 08.12.2018 passed in R.A.No.50/2015 on the file of Senior Civil Judge, Kushtagi by the Lok-Adalat is modified in terms of the aforesaid joint memos. iii) Insofar as land in Sy.Nos.9/11 situated at Kushtagi, which measures 2-Acres 6-Guntas, respondent No.1 herein, who is appellant No.1 in R.A.No.50/2023-24 and plaintiff No.1 in O.S.No.134/2002, would be entitled to 1-Acre 2-Guntas 11-Annas. iv) The petitioner in WP No.101513/2025, who was respondent No.12 in R.A.No.50/2015 and defendant - 16 - NC: 2025:KHC-D:4060 WP No. 105419 of 2024 C/W WP No. 101453 of 2025 WP No. 101513 of 2025 No.13 in O.S.No.134/2002, would be entitled to 2- Guntas and the petitioner in WP No.101453/2025, who was respondent No.11 in R.A.No.50/2015 and defendant No.12 in O.S.No.134/2002, would be entitled to 1-Gunta 5-Annas. v) The trial Court is directed to modify the decree in terms of the above.
