The present petition under Section 528 of BNSS, 2023 has been filed for expeditious disposal of Criminal Case No.3977 of 2023 pending before the Judicial Magistrate First Class, Rajnandgaon. 2. Learned counsel for the petitioner would submit that the petitioner is the complainant and on his complaint FIR of Crime No.163 of 2023 was registered at Police Station, Basantpur, District Rajnandgaon for the offence under Sections 420, 467,468 and 471 IPC. In the year, 2 2023 charge sheet was filed against the respondent No.2/Accused Girdhar Lal Sahu. The charges were framed and case was fixed for recording evidence of the prosecution witnesses. On 27.08.2024 when the petitioner appeared for recording her evidence, the accused took time and her evidence could not be recorded. Thereafter, on 16.12.2024 supplementary charge sheet was filed by the prosecution against the respondent No.3/Co-accused Suman Sahu and thereafter the case is being adjourned for framing of charge against the co- accused Suman Sahu and is still pending since last two years and even charge against the co-accused has not been framed till date. Therefore, the trial court may be directed to expedite the proceeding of aforesaid Criminal Case. 3. On the other hand, learned counsel for the State have no objection if such a direction is given to the trial court for early disposal of the Criminal Case. 4. I have heard learned counsel for the parties and perused the material annexed with the petition. 5. From perusal of material annexed with the petition it transpires that Criminal Case No.3977 of 2023 is pending since 28th June, 2023. From order sheet dated 27.08.2024 it also transpires that the petitioner appeared for recording her evidence when the charge sheet was filed against the respondent No.2-Girdhar Lal Sahu. However, from the order sheet dated 16.12.2024 it transpires that supplementary charge sheet was filed against the respondent No.3/Suman Sahu and thereafter the case is pending for framing of charge as time was taken by the co-accused Suman Sahu for argument on the charge. 3 6. Considering the fact that Criminal Case is pending since June, 2023 and till date the charges have not been framed against the co-accused Suman Sahu, this court deems it appropriate to direct the trial court to expedite the trial and to conclude the same as early as possible. 7. Accordingly, the trial court is directed to expedite the proceeding of Criminal Case No.3977 of 2023 and to conclude the said Criminal Case within a period of six months from the date of receipt of copy of this order, or from the next date of hearing whichever is later. 8.
