1. The appellant has filed the instant appeals under Section 19(1) of the Family Court’s Act arising out of judgment and decree dated 26.10.2024 passed by Family Court, Kunkuri, Jashpur (C.G.) in Civil Suit No. 09-A/2023 whereby the application under Section 13 of the Hindu Marriage Act, 1955 which was filed by the appellant has been rejected. 2. During the pendency of appeals both the parties agreed for amicable settlement and vide order dated 03.03.2025, the matter was referred to Mediation Centre of this Court and both parties have settled their disputes before the Mediation Centre on 04.03.2025, wherein statements of both the parties got recorded and compromise was arrived at between the parties in terms of the settlement agreement dated 03.03.2025, which was duly signed by them. 3. The operative para of settlement agreement dated 03.03.2025 is as under:-

को उभयपक्ष के मध्य

स्वेच्छापूव5क पूण5 सहमतित के साथ सभी दिववादों प दिनपटाा क एवं अपने आपसी वैचारिक
मतभेद एवं दिववाद को खत्म क आगे अलग-
अलग हने हेतु सहमत है।

को नोटी के समक्ष एक ा3ीनागा /
समझौता तैया
दिकया गया है 3ो संलग्न है।
आवेदक द्वाा अनावेदिदका को 32,00,000/- (
0त्तीस लाख रूपये मात्र)

प्रदान कने सहमत है जि3से आवेदक द्वाा मा उच्च न्यायालय में आने वाली ताीख को
अनावेदिदका को उसके नाम (
आंचल अग्रवाल उर्फ5 रूपाली)
से तिGमांG G्राफ्ट के माध्यम से मा.
उच्च न्यायालय के समक्ष प्रदान केगा।
उभयपक्ष इस समझौते के आधा प दिकसी भी प्रका का प्रकण आगे नहीं चलाना चाहते व
आपसी सहमतित से दिववाह दिवच्छेद हेतु सहमत है दिकसी अन्य न्यायालय में लंदि0त प्रकण को
भी आपसी सहमतित से वापस ले लेगें यदिद होतो तथा उभयपक्ष के मध्य दिकसी प्रका का एक-
दूसे प दावा-
आपत्तित्त नहीं है व भदिवष्य में भी नहीं केगें।
उभयपक्ष इस समझौता पत्र की शतO से सहमत हैं एवं पालन के त्तिलए कदिट0द्ध हैं समझौता
पत्र में दी गई शतO को उन्होंने अपनी स्वयं की स्वेच्छापूव5क सहमतित एवं दि0ना दिकसी द0ाव,
भय एवं लालच के स्वीका दिकया गया है उभयपक्ष ने इस समझौता पत्र की शतO को पढने व
समझने के पश्चात् अपनी स्वतंत्र सहमतित से एक-
दूसे की उपस्थिस्थतित में दिनष्पादिदत दिकये है।

Learned counsel for the parties jointly submit that the aforesaid agreement has been arrived at between the parties without any pressure or coercion, out of their own free will, whereby they have amicably resolved the dispute before the Mediation Centre of this Court and therefore, the present appeals may be
disposed of in terms of the aforesaid agreement dated 03.03.2025. They further jointly submit that as per agreement dated 03.03.2025.
5. We have heard learned counsel for the respective parties.

It is pertinent to mention here that the appellant has handed over the amount to the respondent in the form of cash of Rs. 22,00,000/- (Twenty Two Lakhs Rupees Only) and the rest of the amount of Rs. 10,00,000/- (Ten Lakhs Rupees Only) was handed over by the appellant through Demand Draft Bearing No. 002755 of Bank of Baroda dated 08.07.2025 to the respondent before this Court after due verification.

In view of the submissions made by learned counsel for the parties and looking to the terms and conditions of their settlement agreement dated 03.03.2025, this Court therefore, allowed the appeal i.e., FA (MAT) 406/2024 and ordered that the marriage between the appellant and respondent which got solemnized on 18.05.2020 is dissolved from today on the ground of compromise arrived at between the parties and the said agreement will form part of this judgment/decree.
8. Consequently, the appeal FA(MAT) No. 412/2024 in which the application under Section 9 of the Hindu Marriage Act filed by the respondent stands dismissed as the said amount has been received by the appellant as per compromise.
