Sri.Rajendra R.Patil., counsel for the petitioner has appeared in person. 2. Emergent notice to respondents 1 to 6 was ordered on 21.06.2022. A perusal of the office note depicts that respondents 1, 5 and 6 are served and unrepresented. - 3 -

Respondents 1, 5 and 6 have neither engaged the services of an advocate nor conducted the case as a party in person. 3. The captioned Writ Petition is filed seeking a Writ of Certiorari to quash the order dated 15.12.2021 passed by the Court of Senior Civil Judge & JMFC., Kudligi sitting at Sandur on I.A.No.III in MVC.
No.330/2019 marked at Annexure-A and consequently, allow the application at I.A.No.III filed by the petitioner vide Annexure-D.
4. Counsel for the respective parties urged several
contentions. Heard the arguments and perused the Writ papers with care.
5. Suffice it to note that one Mr.Hanasi Basavaraj died in a road traffic accident on 17.12.2018. The wife and children of Mr.Hanasi Basavaraj filed a claim petition seeking compensation in MVC.No.330/2019 before the Tribunal. The owner, driver and insurance company were the parties to the case. The petitioner contends that he is the father of the deceased. However, the claimants did array him as a party to the proceedings. Hence, he was compelled to move an impleading application. The Trial Court rejected the application

solely on the ground that the father is not dependent on the deceased son and he is not a Class-I heir. The reason accorded by the Tribunal in rejecting an application is untenable. The reason is apparent. It is not in dispute that the petitioner lost his son in a road traffic accident. He being a father of the deceased is a proper and necessary party to the claim petition. The Tribunal has overlooked this aspect of the matter and erroneously rejected the application. In my view, the Trial Court has failed to have regard to the relevant considerations and disregarded relevant matters. Hence, this Court deems it proper to quash the order dated 15.12.2021 passed by the Trial Court.
6. The Writ of Certiorari is ordered. The order dated 15.12.2021 passed by the Court of Senior Civil Judge & JMFC., Kudligi sitting at Sandur on I.A. No.III in MVC. No.330/2019 marked at Annexure-A is quashed. Consequently, the application in I.A.No.III filed by the petitioner vide Annexure-D is allowed. The Tribunal is directed to permit the petitioner (Impleading Applicant) to come on record.

Because of disposal of the Writ Petition, all pending interlocutory applications if any are disposed of and the interim
