Crl.M.C.No.2494 of 2025 2025:KER:27632 - 3 - C. JAYACHANDRAN, J. ------------------------------------ Crl.M.C. No.2494 of 2025 ------------------------------------ Dated, this the 01st day of April, 2025 ORDER The petitioner is the 1st accused in C.C. No.1409/2018 pending before the Judicial First Class Magistrate Court-IV (Mobile), Thiruvananthapuram. The petitioner is aggrieved by Annexure-A2 Order, which stipulated the period for renewal of petitioner’s passport as one year in terms of Section 6(2)(f) of the Passports Act, 1967. Learned Counsel for the petitioner would submit that, to pursue his employment opportunity abroad, the period of passport should be not less than three years. 2. Having heard the learned Counsel for the petitioner and the learned Deputy Solicitor General of India, this Court is of the opinion that the period of the passport can be stipulated at two years for the purpose of exemption under Section 6(2)(f) of the Passports Act. The interest of the prosecution will be amply served, if it is
Crl.M.C.No.2494 of 2025 2025:KER:27632 - 4 - pre-conditioned that the petitioner shall not leave India, except with written permission of the trial court. 3. In the circumstances, Annexure-A2 is modified by stipulating the period in the passport for the purpose of exemption under Section 6(2)(f) of the Passports Act as two years (instead of one year), which period will commence from the date of this Order. There is no interference, whatsoever, with Annexure-A2, except to the extent indicated above.
It is further expressly stipulated that the petitioner shall seek specific permission from the trial court before leaving India. The Crl.M.C. is disposed of as above. Sd/- C. JAYACHANDRAN JUDGE SKP/01-04
