: Mr. C.K. Sahu, Advocate Hon'ble Shri Justice Rakesh Mohan Pandey Order on Board
23. 01.2025
1. Heard. 2. Learned counsel for the petitioner would submit that on account of the death of Aadi @ Adhi, an award was passed in favour of parents to the
2 tune of Rs. 6,40,126/-. He would further submit that Rs. 2,50,000/- - 2,50,000/- were deposited as fixed deposits in favour of parents for a period of three years. He would also submit that an application was moved by parents for release of the said amount. It is contended that the learned tribunal partly allowed the application, and the application moved by the petitioner was rejected without assigning any reason. He would pray to allow the application for the release of Rs. 2,50,000/- fixed deposit in the bank account of the petitioner. 3. The learned tribunal has rejected the application moved by the petitioner on the ground that she failed to submit relevant documents with regard to the mortgage of the Tractor, Dozer and Motorcycle etc. The reasons assigned by the learned tribunal appear to be proper. The petitioner is permitted to move a fresh application along with relevant documents before the learned tribunal, and in turn, the learned tribunal is directed to consider the application on its own merits and may pass an order for the release of the amount deposited in the bank account of the petitioner. 4.
With the aforesaid observation(s), the instant petition is hereby disposed of. Sd/-
