PUBLIC PROSECUTOR The Court made the following: As per the directions of My Lord the Hon’ble the Chief Justice, this criminal petition has been allotted to this Bench by notice dated 25.03.2025 and the same is treated as part of the roster effective from 26.03.2025. A.1 & A.2 in Crime No. 161 of 2024 on the file of Railway Kodur Police Station, Annamayya District, filed the present application under Section 438 Cr.P.C, seeking anticipatory bail. The said crime was registered for the offences punishable under Sections 448, 324, 354, 506, 509 r/w 34 IPC. 2. \ Subsequently Section 324 IPQ was altered to Section 326 I PC after receiving the Wound Certificates 1 & 2. As seen from the records, the petitioners filed similar application vide Criminal Petition No.5210 of 2024 before this Court, which was withdrawn vide 3. order dated 22.08.2024 as by that time Section 326 IPC has not been introduced. It is alleged by the de facto complainant that she is the housewife and her marriage was performed about 30 years back and she was blessed with a daughter and son who were married. The son-in-law of the de facto complainant was doing job in Tirupati and daily he used to go to Tirupati and return to the village. About 10 years prior to the date of incident, the husband of the de facto complainant has given certain agricultural land to one Chengaiah for his livelihood. It is further alleged that the petitioners had an eye on the said property to knock away the same. About 3 years prior to the date of incident, the petitioners beat said Chengaiah and a case was registered against the petitioners and subsequently at the intervention of the elders, said case was compromised. While so, on 30.04.2024 at about 04.50 p.m., the petitioners again beat said Chengaiah and the elders admonished them. At about 07.45 p.m. on the same day, when the de facto complainant along with her husband and daughter were in the house, the petitioners along with 20 others, armed with deadly weapons, came there and beat them and left the scene. It is alleged that LWs 1 to 4 received injuries. On the basis of the same, the present crime has been registered. Learned counsel for the petitioners contends that the petitioners also received injuries in the hands of the prosecution party and they also gave a report to the police, but the police did not register any crime. It is further contended by the learned counsel for the petitioners that the petitioners are closely related to the de facto complainant. There is a dispute between the accused and de facto complainant with regard to the laying of agricultural pipeline. I / In view of the above facts and circumstances and as the petitioners and de facto complainant are closely related to each other, this Court is inclined to grant anticipatory bail to the petitioners / A. 1 and A.2 on the certain conditions: / i) The petitioners / A.1 & A.2 are directed to surrender before the Station House Officer, Railway Kodur Police Station, Annamayya District, on or before 10.04.2025. On such surrender, the Station House Officer, Railway Kodur Police Station, Annamayya District, is directed to release the petitioners / A.1 & A.2 on bail on their executing a personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties for the like sum each to the satisfaction of the Station House Officer, Railway Kodur Police Station, Annamayya District. ii) Petitioners / A.1 & A.2 shall make themselves available for interrogation as and when required, and they shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer. iii) Petitioners / A.1 & A.2 are directed to appear before the Station House Officer, Railway Kodur Police Station, Annamayya District, once in a week i.e., further orders.on every Monday between 10.00 A.M. and 01.00 P.M. until iv) Petitioners / A.1 & a.2 Investigating Agency.
