Rakesh Sharma reported in (2020) 9 SCC 1, Wherein the judgment passed in the case of Prakash and Ors. Vs. Phulavati and Ors. (2016) 2 SCC 36, upon which the petitioner has placed reliance, has been overruled. In view of the submissions made at bar and looking to the law settled in the case of Vineeta Sharma (supra) nothing survives for adjudication in this case and therefore the present writ petition is dismissed in the light of the judgment of Vineeta Sharma (supra).
