He places on record report of the Investigating Officer wherein the Investigating Officer has sought permission to file charge-sheet by vacating the stay operating in favour of the applicant. In view of the above, learned advocate Mr. Pravin Gondaliya appearing on behalf of the applicants, upon instructions, seeks permission to withdraw the present application with a liberty to file an appropriate application before the competent Court, including discharge application as and when the charge-sheet is filed. Permission as prayed for is granted with the above liberty. The present application is dismissed as withdrawn. It is made clear that this Court has not gone into the R/CR.MA/13077/2022 ORDER DATED: 19/06/2025 merits of the case and withdrawal of this petition shall not come in the way of the applicant for filing an application for discharge and the same may be considered on its own merits without being influenced by the present order.
