Heard Mr. Tarendra Kumar Jha, learned counsel for the petitioners as well as Mr. Shailendra Sharma, learned Panel Lawyer, appearing for the State/respondent No.1. 2. The present petition has been filed by the petitioner with the following relief(s):- “1. It is therefore prayed that, this Hon'ble Court may kindly be pleased to exercise its inherent jurisdiction under Section 528 of BNSS, and in exercise thereof call for the records, if necessary, admit the petition and after hearing parties in the matter and allow this CRMP and quash FIR no. 84/2023 in P.S. Mahila Thana Durg, dated 05.08.2023 and entire charge sheet in which offences are registered under section 498 (A) and 34 of IPC (ANNEXURE A/1) in the interest of justice. 2. It is therefore prayed that, this Hon'ble Court may kindly be pleased to allow this CRMP To quash order taking cognizance dated 05.05.2025 and the subsequent criminal proceeding in RCC/17104/2025 3 pending before the court of learned Judicial Magistrate First Class Durg, District (C.G.) (ANNEXURE A/2) in the interest of justice.” 3. Learned counsel for the petitioner seeks permission of this Court to withdraw the present petition with liberty to file afresh at an appropriate stage, as it has been submitted that a non-bailable warrant has been issued against the petitioner, which has not yet been challenged. 4. Learned counsel for the State has no objection to the said prayer. 5. Accordingly, the writ petition is dismissed as withdrawn with the aforesaid liberty in favour of the petitioner. 6. The certified copies of the impugned FIR, charge-sheet, and other documents filed along with the annexures be returned to the petitioner after retaining photocopies thereof on record.
