ORDER:
1. The learned counsel for the petitioner submitted the petitioner is apprehending danger and threat from her husband and that the divorce petition is pending before Family Court at Visakhapatnam vide FCOP.No.1928 of 2021 and after filing transfer petition before Hon’ble Supreme Court of India, the matter was transferred to Family Court at Dwaraka District Courts, New Delhi.
2. It is submitted that the petitioner has filed a complaint against her husband and in this regard she has been in correspondence with II Town Police Station, Visakhapatnam by way of e-mail. The police have addressed notice to the petitioner to submit the documentary evidence for the purpose of investigation. Since there is apprehension of danger in the hands of her husband, the petitioner approached this Court permit her to submit the documentary evidence by way of e-mail and if necessary she will appear before the Station House Officer, II Town Police Station, Visakhapatnam.
3. The learned Assistant Government Pleader submitted that the petitioner may submit a soft copy of the documents to the 3'-'' respondent by of e-mail and on receipt of the said document(s) and other to way material documents if any required by the 3^^ respondent, the 3^^ respondent
shall proceed with investigation and also the petitioner’s appearance in person if necessary.
4. Considering the apprehension and petitioner, this Court inclined to dispose off the requested this Court to direct threat from the husband of present writ petition by directing the petitioner to submit the document(s) if any required by the respondent, the same shall submit by way of e-mail and the S'"'' respondent shall consider it and to proceed with the investigation.
5. Accordingly, the writ petition is disposed off without costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
