Ajay Mohan Goel, Judge (Oral) By way of this writ petition, the petitioner has inter alia prayed for following reliefs:- “(i). That the writ in the nature of mandamus or any other appropriate writ(s), order directions directing the respondents particularly the respondent No.1 to issue the enabling notification in terms of Policy, 2019, with in stipulated period in favour of the petitioner. (ii). That the writ in the nature of mandamus or any other appropriate writ quash in Clause 5B policy 2019 alongwith Incentive Rule 4 B sub rule b and rule 4 F of the Rules to the extent they are inconsistent with the Industrial Policy, 2019 (iii). That the writ in the nature of mandamus or any other appropriate writ declaring that the tariff orders for the years 2020-2021 to 2024-2025 on wards for the large/medium Industrial Power Supply to be read in consonance with the 1Whether the reporters of the local papers may be allowed to see the Judgment?Yes 2 Industrial Policy of the State and to declare contrary provisions such tariff orders be ineffective.” 2. Learned Additional Advocate General submits that in light of the adjudication by the Hon’ble Supreme Court of India in Civil Appeal No.008155/2026 arising out of Special Leave Petition No. 26731/2025, titled State of Himachal Pradesh and others versus M/s Kundlas Loh Udyog, the present petition does not survive. Learned counsel for the petitioner acknowledges the same. 3. The petition is accordingly disposed of as such, so also pending miscellaneous application(s), if any.
