ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“....a Writ of Certiorari, calling for the records relating to the award made in I.D.No.61 of 2014 dated 18.02.2015 on the file of Labour Court, Anantapur, which was published in gazette vide G.O.Rt.No.302, dated 08.06.2015 as illegal, arbitrary and to quash the same. ”
2. When the matter is taken up for hearing, Sri Aravala Rama Rao,
learned counsel for the Petitioner would submit that Respondent No.1 is a
driver and while discharging his duty, he failed to oblige the request of the passengers to stop the bus at a vegetarian hotel, for which, an enquiry has been initiated against him and he of annual increment for was imposed with punishment of deferment one year with cumulative effect.
Learned counsel would further submit that, against the said punishment, the Driver preferred an same were rejected. Aggrieved thereby, of 2014, wherein, the Labour Court Appeal and also Revision and the Respondent No.1 preferred I.D.No.61 aside the punishment and also i Department. Being aggrieved, the APSRTC set imposed costs of Rs.5,000/- on the filed the present writ petition, being an employee of RTC, Respondent No.1 has to maintain cordial relation with the passengers. In the facts and circumstances of the present case, this Court does not find any reason to interfere in the;Award passed in I.D.No.61 of 2014 with regard to setting aside the punishment imposed against Respondent No.1 herein (Driver). 6. In that view, the Writ Petition is partly allowed setting aside the order of payment of costs of Rs.5,000/- to Respondent No.1 (Driver) by the Petitioner herein. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed. That Rule Nisi has been made absolute as above.
