He filed Kalandra against Police Officers. As per judgment of Hon’ble Supreme Court in Nilabati Behera alias Lalita Behera vs. State of Orissa and others, AIR 1993 Supreme Court 1960, writ petition is maintainable for violation of human rights and Court may grant compensation. 4. Notice of motion. 5. Mr. Aman Dhir, DAG, Punjab, who on advance notice is present in Court, accepts notice. 6. With the consent of both sides, the petition is taken up for final disposal. 7. Learned State counsel submits that there is no evidence on record disclosing much less confirming allegations of the petitioner. In the absence of conclusive evidence or findings recorded by one or another authority, petitioner cannot be granted compensation. He on the earlier occasion preferred CRM-M- 46320 of 2023 seeking constitution of Special Investigation Team (for short “SIT”) which was dismissed. 8. Heard the arguments and perused the record. 9. As per petitioner, alleged incident took place in August’2023. He filed CRM-M-46320 of 2023 before this Court seeking constitution of SIT to inquire the matter. The said petition was dismissed. He has preferred Kalandra before jurisdictional Court. The petitioner is right while claiming that in case of violation of human rights, compensation should be granted, however, petitioner has failed to point out findings of any authority or Court disclosing that his allegations are prima facie correct. In the absence of evidence or findings recorded by any authority or Court to the effect that PARAMJIT KAUR SAINI 2026.04.08 04:44 I attest to the accuracy and integrity of this document CWP No. 29353 of 2025 -3- petitioner was actually subjected to third degree treatment, this Court cannot award compensation. The petitioner should await outcome of Kalandra. If it is held that he was subjected to ill treatment, he would be accordingly entitled to compensation. 10. In the wake of above discussion and findings, the petition stands disposed of.
