1. Heard.
2. This is the first bail application filed under Section 483 of the BNSS, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.14/2020 registered at
2 Police Station Gangalur, District Bijapur (C.G.), for the offence punishable under Sections 147, 148, 149, 364, 302, 323, 341 of the IPC & Section 25 of the Arms Act.
3. Case of the prosecution, in brief is that, complainant Raju Punem lodged an oral complaint to P.S. Gangalur that on 01/09/2020 that he went to Gangalur for filing the admission form of class 10th. Thereafter, when he returned on 04/09/2020 her mother and grandfather told him that on 03/09/2020 approx. 40-45 naxalite came his house and they took his father and grandfather to forest of Dumlipalnar where they killed his father. Upon receiving such information, FIR has been registered and during the course of investigation, applicant has been arrested.
4. Learned counsel for the applicant contended that, the applicant is innocent and she has no connection with the alleged crime whatsoever. The allegations leveled by the prosecution are baseless and without any nexus. If the applicant will be released on bail by this Hon'ble Court, she will never misused the same. He further contended that, neither appellant was identified nor any prohibited article was seized from the applicant. The applicant is in jail since 29/11/2023 and the trial will take considerable time for its conclusion, therefore the applicant may be released on bail.
5. Learned State Counsel opposes the submissions made by

learned counsel for the applicant.
6. I have heard learned counsel for the parties and perused the case diary.

Considering the facts of the case, submission made by learned counsel for the parties and further considering that the trial Court finds that the applicant is accused of abducting and assaulting Sannu Punem in the jungle of Dumripalnar under Gangalore police station area on 03.09.2020 and causing the murder of Sannu Punem. In view of its seriousness and after considering other circumstances, it does not seem appropriate to grant bail to this applicant/accused. Looking to the nature and seriousness of the case, this Court is of the opinion that is not a fit case to enlarge the applicant on bail.

Accordingly, the bail application of the applicant- Rukhni @ Namita Potam filed under Section 483 of the BNSS, involved in Crime No.14/2020 registered at Police Station Gangalur, District Bijapur (C.G.), for the offence punishable under Sections 147, 148, 149, 364, 302, 323, 341 of the IPC & Section 25 of the Arms Act, is rejected.
9. However, this Court hopes and trust that the trial Court shall make an earnest endeavour to conclude the trial in accordance with law as expeditiously as possible, if there is no legal impediment.
