Advocate for appellant Advocate for respondents CORAM :THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE RAVI CHEEMALAPATI DATE : 28th April 2025 PC : The present Writ Appeal has been preferred against the interim order dated 27.03.2025 passed in W.P.No.6079 of 2025. 2. By virtue of the said order, direction has been issued to the official respondents to supply essential commodities to the fair price shop No.0789030 of the petitioner in the writ petition. The direction was issued primarily on account of the failure of the official respondents to report instructions in terms of the order passed by the learned single Judge. Learned counsel for the appellant would submit that even when the 3. appellant was a necessary party before the learned single Judge, she was not 2 incorporated as such in the writ petition and that even when the appellant had been appointed as a fair price shop dealer on a temporary basis and was supplying 420 card holders the requisite ration, the temporary arrangement in favour of the appellant could not have been disrupted without affording opportunity of being heard to the appellant. an 4. On a perusal of the order impugned, it can be seen that the petitioner had questioned the suspension of the fair price shop license of the petitioner as also the appointment of the appellant as a temporary dealer has been contrary to the rules and regulations applicable in the instant case. It appears that in the absence of an appropriate response and instructions reported by the official respondents, interim direction has been issued. While the appellant thus seems to have been appointed as a fair price shop dealer temporary basis, it would not, in any manner, take away the right of the petitioner as the existing fair price shop dealer to question the order of suspension on grounds which are available to her and mentioned in the writ petition. on 5. We are of the opinion that in case the appellant has any right, she can approach the learned single Judge with a prayer seeking impleadment and for vacation of the interim order, if so advised. We do not find any reason to interfere with the order impugned. 6. Accordingly, this Writ Appeal is dismissed. No order as to costs. 3 Pending miscellaneous applications, if any, shall stand closed.
