This application under Section 529 BNSS has been filed with a prayer to direct the court concerned to decide the application under section 193(9) B.N.S.S. in Case No.13169 of 2024 (State Vs. Dudhanath Mani and others) arising out of case crime no.315 of 2024 under sections 103(1), 123 B.N.S., Police Station Gauribazar, District Deoria, pending in the Court of Chief Judicial Magistrate, Court No.17, Deoria, expeditiously within a stipulated period. 2. Heard learned counsel for the applicant and learned counsel for the opposite parties no.2 & 3 as well as learned A.G.A. for the State. 3. It is submitted by the learned counsel for the applicant that the applicant before this Court is the informant of this case. Although charge-sheet has been submitted in this case but since the matter was minimize by the Investigating Officer, the petition under section 193(9) B.N.S.S. seeking further investigation in this matter was moved by the informant on 7.12.2024 before the trial court and the same is still pending and feeling aggrieved with the pendency of the application, the present application u/s 529 B.N.S.S. has been moved by the applicant. 4. I have considered the submissions and perused the record. 5. In the facts and circumstances of the case, the trial court is directed to dispose of the said petition for further investigation in accordance with law within a period of two months from the date of production of certified copy of this order before it. 6.
