Neutral Citation No. - 2025:AHC:106463-DB Court No. - 29 Case :- WRIT - C No. - 11961 of 2025 Petitioner :- Dasharath And 3 Others Respondent :- State Of Uttar Pradesh And 5 Others Counsel for Petitioner :- Amarnath Tripathi,Vishal Mishra Counsel for Respondent :- C.S.C. Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Vinod Diwakar,J. 1. Heard learned counsel for the petitioners and Shri Akhileshwar Singh, learned Addl. Chief Standing Counsel for State respondents. 2. The instant writ petition has been preferred for quashing the order dated 02.01.2025 and for a direction to respondents to grant compensation to the acquired land of the petitioners. 3. Learned Addl. Chief Standing Counsel has vehemently opposed the writ petition and submitted that highly disputed facts have been raised in this writ petition, which cannot be adjudicated under Art.226 of the Constitution of India. 4. Considering the facts and circumstances of the case, we find that the grievance of the petitioners can very well be looked into, examined and redressed by the District Level Committee constituted under the G.O. dated 12.05.2016. Accordingly, the order impugned dated 02.01.2025 is set aside. The matter is relegated to the District Level Committee constituted under the G.O. dated 12.05.2016 to consider and decide the claim of the petitioners in accordance with law and submit its report to the competent authority i.e. concerned District Magistrate within four weeks from the date of production of certified copy of this order along with fresh application to be moved by the petitioners. It is made clear that we have not expressed any opinion on merits of the issue. 5. The writ petition stands disposed of accordingly.
