The present application has been filed seeking condonation of delay in laying challenge to the impugned
judgment dated 02.09.2024, whereby an application filed under Section 156(3) of the Cr.P.C., seeking direction to the concerned SHO to register an FIR against the respondents under Sections 192, 193, 120B, 167, 341, 342, 323, 347 read with Section 34 of the IPC, has been dismissed.
In filing the petition, there is a delay of 362 days. In condoning the delay, it is not the length of delay which matters. What is relevant is the sufficient cause shown for the delay in preferring the petition. The explanation offered should not be an excuse. Besides, each day’s delay is not to be explained.
From a perusal of the pleadings in the case at hand, in my considered view, there exists sufficient cause/explanation for the delay in filing of the present
petition through a Legal Aid counsel. Hence, the application is allowed and delay is condoned. The application stands
disposed of.
