The present petition has been filed by the petitioner with the following prayer: “It is, therefore, prayed that this Hon’ble Court may kindly be pleased to allow this petition and quash the FIR No. 128 of 2022 under Section 420, 467, 468, 471, 201 and 34 of Indian Penal Code at Police Station Kotwali, Raipur, District Raipur (C.G.) and also quashing the enter criminal proceedings arising from this crime, in the interest of justice.” 3. Learned State counsel submits that in the present case charges have already been framed against the petitioner on 28.04.2023 and the case is fixed for evidence, to which learned counsel for the petitioner prays that the present petition be dismissed as withdrawn with the liberty to challenge the order of framing charges against the petitioner. 4. Prayer is allowed. 5. In view of the submission made by the learned counsel for the petitioner, the present petition is dismissed as withdrawn with the liberty to the petitioner to take recourse to law before the appropriate forum, if so advised.
