This Petition has been filed by the Petitioner/wife under Section 24 CPC seeking transfer of Civil Suit No.87-A/2023 from the Family Court, Katghora, District Korba to the Family Court, Bilaspur, District Bilaspur. 2. Brief facts of the case are that the parties were married to each other on 12.05.1999 as per Hindu rites and customs and out of the said relation, they had two children. It is alleged that the marital bond between the parties stood on the rocks soon after the marriage and the Respondent/husband has also filed an application under Section 13(1-a)(1-b) of the Hindu Marriage Act, 1955 for grant of divorce. 3. Learned Counsel for the Petitioner/wife submits that the Petitioner/wife has a poor health and the doctor has advised her not to travel long, therefore, it is very difficult for her to attend the proceedings at the Family Court, Katghora, District Korba. He further submits that the Petitioner has no support, whatsoever, she has financial constraints and is required to shoulder the personal and professional responsibilities on her own, therefore, the said case may be transferred as prayed for. 4. Per contra, learned Counsel for the Respondent/husband opposes the said prayer. 3 5. Having considered the submissions made, this Court deems it appropriate to transfer Civil Suit No.87-A/2023 from the Family Court, Katghora, District Korba to the Family Court, Bilaspur, District Bilaspur with immediate effect. Ordered accordingly. The parties are directed to appear before the Family Court, Bilaspur, District Bilaspur on 25/11/2025 for further proceedings. The Respondent/husband may be permitted to appear through Video Conferencing to attend the proceedings before the said Court. The Family Court, Katghora, District Korba shall transfer the record to the Family Court, Bilaspur, District Bilaspur immediately. 6. Resultantly, the instant Transfer Petition is allowed.
