The instant petition has been filed for the following relief: "to issue a writ, order or direction in the nature of mandamus directing the respondent no.1/ Settlement Officer of Consolidation, District- Mau to decide the Appeal No.548 / 1073 of 2017 (Computerized Case No.20205415510000775) (Surendra Dayal and another vs. Ramnarayan Prasad), under Section 11 (1) of U.P. Consolidation of Holdings Act, 1953 expeditiously as possible as soon as within a stipulated period as fix by this Hon'ble Court in the interest of justice." 3. Learned counsel for the petitioner submitted that the time barred title appeal filed by private respondent is pending before respondent no.1/ Settlement Officer of Consolidation, Mau since 29.5.2017, as such, the appropriate direction be issued for expeditious disposal of pending time barred appeal within a time bound period. 4. I have considered the argument advanced by learned counsel for the parties and perused the records. 5. There is no dispute about the fact that the title appeal filed by private respondent is time barred. 6. No case for expeditious disposal of pending time barred appeal is made out. 7. The writ petition is dismissed.
