The present writ petition has been filed seeking a direction to respondent nos. 2, 4 and 5 to remove the electricity pole installed in the Khasra No. 494 area 1.467 hectare situated at Village Assa, Pargana Hastinapur, Tehsil Mawana, District Meerut unil the final decision of Case No. T202411520305419 (Neeraj Vs. Satish and others), under Section 116/117 of the U.P. Revenue Code, 2006 pending in the court of respondent no.6 i.e. Sub Divisional Magistrate, Tehsil Mawana, District Meerut. After hearing learned counsel for the parties and perusing the records, we are of the view that since the ownership of the property has still not been decided and an application is pending under Section 116/117 of the U.P. Revenue Code, 2006, this Court cannot at this stage intervene in the matter. The petition is, accordingly, disposed of with liberty granted to the petitioner to first await the out come of the proceedings under the U.P. Revenue Code, 2006.
