1. By way of the instant petition, the petitioner has prayed for the following reliefs:- 10.1 This Hon’ble Court may kindly be pleased to call for ASHUTOSH MISHRA Digitally signed by ASHUTOSH MISHRA Date: 2025.09.25 19:19:45 +0530
2 / 4 the entire records in relation to the claim application case of the petitioner (Revenue Case No.69/v/121/2008-2009) at the behest of application dated 31.01.2006 preferred by father of petitioner, from the possession of the respondent authorities, for its kind perusal; 10.2 This Hon’ble Court may further kindly be pleased to issue appropriate writ(s)/order(s)/direction(s), directing the respondent authorities to expeditiously pass appropriate speaking order in claim application case of the petitioner (Revenue Case No.69/v/121/2008-2009), in compliance of the order dated 26.08.2013 passed by this Hon’ble Court in WPC No.1228 of 2013, by holding proper inquiry and by providing proper opportunity of hearing to the petitioner; 10.3 This Hon’ble Court may further kindly be pleased to issue appropriate writ(s)/order(s)/direction(s), directing the respondent authorities to conclude the proceeding in claim application case of the petitioner and thereby grant appropriate compensation amount or allot alternate land to the petitioner as per thee prevailing laws and scheme of the State Government, in lieu of acquisition of his lands, in the interest of justice. 10.4 That this Hon’ble Court be pleased to grant such other relief(s) in favour of the petitioner, as it may deem fit and proper in the interest of justice;
2. The brief facts of the case are that on 09.12.2005 some portion of Khasra No. 210 admeasuring Rakba 1870 Sq. Meter and Khasra No. 435 admeasuring 2830 sq.mtr. belonging to petitioner's ancestors released under the Ceiling Act. Thereafter, on 31.01.2006 Father of petitioner filed claim application seeking allotment of alternate land in lieu of acquisition of his lands due to construction of Ring Road in Raipur. Thereafter, on 27.09.2012 SDO (Revenue), Arang- Abhanpur, by order dated 27.09.2012, forwarded the report to the Additional Collector, Raipur, for further proceedings in respect of compensation and allotment of land. On 26.08.2013 Writ Petition bearing WPC No. 1228/2013 preferred by petitioner disposed of by
3 / 4 this Court directing the Learned Collector Raipur to take appropriate decision in the claim application case of the petitioner by holding proper inquiry within four months.
On 11.11.2019 Contempt Petition alleging disobedience of the Court order in WPC No. 1228 of 2013 got dismissed being time barred, although grating liberty to the petitioner to file fresh petition. On 29.08.2025 the petitioner preferred detailed representation before Learned Collector and Additional Collector, Raipur, seeking certified copies of the orders/proceeding initiated in his claim case and also requested to pass appropriate order in compliance of the Court order in his writ petition and thereby either allot him alternate land or grant him compensation. 3.
Learned counsel for the petitioner would contend that till date the compensation has not been granted to the petitioner and the petitioner has preferred a detailed representation before the Collector and Additional Collector, Raipur and requested to pass appropriate
order in compliance of the order passed by this Court and the case of the petitioner has not been decided despite the order passed by this Court.
4. Learned State counsel would contend that they have no objection in deciding the case of the petitioner.
5. Considering the entire facts & circumstances of the case, especially considering the time period which has passed and this Court has also passed an order in the year 2013 in a writ petition filed by the
4 / 4 petitioner, it is directed that the concerned respondent shall decide the Revenue Case No.69/v/121/2008-2009, which is pending before the Tehsildar, Raipur within a period of 120 days from the date of production of copy of this order, in accordance with law.
6. It is made clear that this Court has not expressed any opinion on the merits of the case and the respondent authorities shall decide the case of the petitioner on its own merits.
7. With the aforesaid observation, the instant writ petition stands
