By means of this petition filed under Article 226 of the Constitution, petitioner prays for grant of one notional annual increment for determining revised pensionary benefit and pay the arrears with interest. 3. Submission advanced by learned counsel for the petitioner is that not only there are authorities of Supreme Court and High Court in respect of rights of retired employees to receive annual increment on 1st July and 1st January of the calendar year even though they retired on a previous date, but even the State Government also has issued a Government Order in the above regard on 12th June, 2024 directing for payment of annual increment to all such employees. 4. Learned counsel appearing for the respondent does not dispute the legal position as discussed above. 5. Having heard learned counsel for the respective parties and having perused the records, I find that Government Order was issued by the State Government on 12th June, 2024, which stipulated for payment of one notional annual increment to the employees, who retired on 30th June or 31st December. The Government Order dated 12th June, 2024 is reproduced hereunder: "प्रेषक, दीपक कु मार, अपर मुख्य सचिव उत्तर प्रदेश शासन सेवा में, 1.समस्त अपर मुख्य सचिव/प्रमुख सचिव/सचिव उत्तर प्रदेश शासन। 2.समस्त विवभागाध्यक्ष/काया"लयाध्यक्ष, उत्तर प्रदेश। 3.समस्त मण्डलायुक्त/ जि(लाचि)कारी, उत्तर प्रदेश। विवत्त (सामान्य) अनुभाग-3 लखनऊः विदनांक 12 (ून, 2024 विवषय- विदनांक 30 (ून/31 विदसम्बर को सेवा विनवृत्त होने वाले उ०प्र० राज्य सरकार के कार्मिमकों की सेवाविनवृत्तित्त की चितथि; (30 (ून/31 विदसम्बर) के ठीक अगले विदन अ;ा"त 01 (ूलाई/01 (नवरी को वेतनवृचि> विनयत होने पर ऐसे कार्मिमकों की पेंशन की गणना हेतु एक नोशनल वेतनवृचि> (ोडा (ाना। महोदय, उपयु"क्त विवषय के सम्बन्) में अवगत कराना है विक वेतन सविमचित, उत्तर प्रदेश (2008) की संस्तुचितयां विदनांक 01.01.2006 से लागू की गई है, जि(समें कम"ारिरयों की वार्मिषक वेतनवृचि> प्रत्येक वष" विदनांक 01 (ुलाई को अनुमन्य की गई। तत्पश्चात, वेतन सविमचित, उत्तर प्रदेश (2016) की संस्तुचितयां विदनांक 01.01.2006 से लागू की गई जि(सके अन्तग"त राज्य सरकार के कम"ारिरयों को वार्मिषक वेतनवृचि> विदनांक 01 (ुलाई अ;वा 01 (नवरी को ुनने का विवकल्प विदया गया है। 2. राज्य सरकार के अनेक अचि)कारी/कम"ारी अचि)वष"ता आयु प्राप्त कर प्रचित वष" विदनांक 30 (ून/31 विदसम्बर को सेवाविनवृत्त होते हैं जि(न्हें य;ास्थिस्;चित क्रमशः 01 (ुलाई/01 (नवरी को वेतन वृचि> अनुमन्य होती है परन्तु उन्हें आगामी वेतनवृचि> प्रदान नहीं की (ाती क्योंविक ऐसे अचि)कारी/कम"ारी मात्र एक विदन पूव" अ;ा"त 30 (ून/31 विदसम्बर को अचि)वष"ता आयु के आ)ार पर सेवाविनवृत्त हो ुके होते हैं। 3. मा० उच्चतम न्यायालय द्वारा विवथिभन्न वादों में यह विनण"य विदया गया है विक ूंविक उक्त कम"ारी वेतनवृचि> के उपरान्त 01 वष" की सेवा पूण" कर सेवाविनवृत्त होते है, अतः उन्हे वेतनवृचि> अनुमन्य होगी मा० उच्च न्यायालय इलाहाबाद द्वारा भी विवथिभन्न वादों में इसी आशय के आदेश पारिरत विकये गए है। 4. मा० उच्चतम न्यायालय एवं मा० उच्च न्यायालय , इलाहाबाद द्वारा पारिरत आदेशों के अनुपालन में राज्य सरकार द्वारा सम्यक् विवारोपरान्त यह विनण"य त्तिलया गया है विक विदनांक 30/31 विदसम्बर को सेवाविनवत्त होने वाले राज्य सरकार के कार्मिमकों, जि(न्हें य;ास्थिस्;चित 01 (ुलाई/01 (नवरी को वेतनवृचि> विदया (ाना विनयत है, द्वारा आहरिरत अंचितम वेतन में एक नोशनल वेतनवृचि> (ोडते हुए पेंशन एवं ग्रेच्युटी आगमन विकया (ाय। विदनांक 01 (ुलाई को वेतनवृचि> प्रदान विकये (ाने सम्बन्)ी व्यवस्;ा विदनांक 01.01.2006 में प्रभावी वेतन सविमचित, उत्तर प्रदेश (2008) की संस्तुचितयों के क्रम में लागू की गयी है। अतः इन आदेशों में से कार्मिमक भी आच्छाविदत होंगे (ो विदनांक 01.01.2006 के उपरान्त परन्तु शासनादेश विनग"त होने के पूव" सम्बंचि)त वष" की 30 (ून को सेवाविनवृत्त हो ुके ;े परन्तु उन्हे यह नाम तात्कात्तिलक प्रभाव से अनुमान्य होगा त;ा उन्हे एरिरयर का भुगतान अनुमन्य नहीं होगा। यह अवस्;ा विदनांक 01.01.2016 के उपरान्त परन्तु शासनादेश विनग"त होने की चितथि; के पूव" सेवाविनवृत्त 2 of 3 उन कार्मिमकों पर भी लागू होगी (ो सम्बंचि)त वष" की 30 (ून/31 विदसम्बर को सेवाविनवृत्त हुए त;ा जि(न्हें य;ास्थिस्;चित 01 (ुलाई/01 (नवरी को वेतनवृचि> देय ;ी। उक्त आदेश शासनादेश विनग"त होने की चितथि; से लागू होंगे। दीपक कु मार अपर मुख्य सचिव" 6. In view of the above, this petition stands disposed of with a direction to the respondent concerned to look into and consider the claim of the petitioner and pass appropriate order in the light of the Government order dated 12th June, 2024 as quoted herein above. 7.
