The captioned Writ Petition is filed seeking a Writ of Mandamus directing respondent No.3 to re-issue the passport to the petitioner by positively considering the representation of petitioner dated 09.09.2022 vide Annexure-B. 3. The short facts are these: The petitioner contends that he has lost passport at Belgavi, as such he has lodged a compliant with the Gokak Police Station regarding loss of passport. He also filed an application to the third respondent seeking re-issuance of the fresh passport. The third respondent sought for clarification regarding pending petition in P.C.No.122/2021 on the file of JMFC, Belgavi. The petitioner’s grievance is that despite several oral requests and representations the third respondent is not re-issuing the passport to the petitioner. Under these - 3 - NC: 2025:KHC-D:4471 WP No. 104090 of 2023 circumstances, the petitioner has filed the present Writ Petition on several grounds as setout in the Memorandum of Writ Petition. 4. Counsel for the respective parties urged several contentions. Heard the arguments and perused the Writ papers with utmost care. Counsel for the petitioner submits that a memo has been filed stating that the B-report has been filed in respect of P.C.No.122/2021 and the same may be placed on record. Counsel therefore submits that an appropriate order may be passed. Counsel for the respondents submits that because of filing of B-report an appropriate order may be passed. The oral submission made by counsel for the respective parties and the memo is placed on record. 5. Because of the filing of the B-report in respect of P.C.No.122/2021, this Court deems it proper to direct the third respondent to consider the application that has been filed by petitioner and take necessary steps to re-issue of the fresh - 4 - NC: 2025:KHC-D:4471 WP No. 104090 of 2023 passport, in accordance with the law within eight weeks from the receipt of certified copy of this order, on the satisfaction that no criminal cases are pending against the petitioner as of today. 6.
