SUBMISSIONS ON BEHALF OF THE APPELLANT-STATE :-
4. Learned APP appearing for the appellant-State would mainly submit that informant is the eye-witness of the occurrence in question and he is the brother of the deceased. It is further submitted that there are three eye-witnesses to the occurrence in question and all the eye-witnesses supported the case of the prosecution. Learned APP, therefore, urged that when the eye- witnesses have supported the case of the prosecution, the trial court ought to have convicted the respondents accused. Learned APP has also referred the deposition given by the IO (PW 11) and pointed out the manner in which the said IO has carried out the investigation and collected the evidence against the respondents accused. Learned APP urged that the impugned judgment be quashed and set aside and thereby the respondents accused be convicted for the alleged offence.

Patna High Court G. APP. (DB) No.10 of 2000 dt.08-07-2025 6/32
5. On the other hand, learned Advocate Ms. Saloni Saran, appearing for the respondents accused has vehemently opposed the present appeal. It is submitted that there are major contradictions and inconsistencies in the deposition of the prosecution witnesses.

Learned counsel further submits that the trial court has not committed any error while passing the impugned
judgment of acquittal. At this stage, learned counsel has placed reliance upon the decision rendered by the Hon’ble Supreme Court in the case of Chandrappa and Ors. Vs. State of Karnataka, reported in (2007) 4 SCC 415 and contended that even if two views are possible one view taken by the trial court cannot be retracted. (DB) No.10 of 2000 dt.08-07-2025 23/32 not find any mark of dragging in the filed of Triveni Singh. He did not recorded the distance of the blood stains found in the field of Triveni Singh. 16.2. In paragraph 7 of his cross-examination, he had deposed that he did not seize the clothes worn by the deceased and did not send the blood seized for chemical examination. OBSERVATIONS AND REASONING: -
17. We have re-appreciated the entire evidence led by the prosecution. At the outset, it is pertinent to note that the fard-beyan of the informant (PW 9) came to be recorded at 10:30 PM on 13.11.1994 for the incident which took place at 04:45 PM. It is the case of the informant in the fard-beyan that his brother had gone with one Shashi Bhushan Singh and Rajendra Singh to field. The informant also went to the field and, as per his case, he is eye- witness to the occurrence in question. In the fard-beyan, he has narrated the manner in which the incident took place. As per his fard-beyan, Rajendra Singh is also a witness to the incident in question. It is his specific case in the fard-beyan that after the incident took place, Chowkidar Bhagwan Das came at the place of occurrence and the informant gave information to him and sent him to the police station for informing the police. Patna High Court G. APP. (DB) No.10 of 2000 dt.08-07-2025 24/32
17.1. Keeping in view the aforesaid fard-beyan, if the deposition of PW 1, Rajendra Singh, which we have discussed hereinabove, is carefully examined, it is revealed that PW 1, Rajendra Singh, has also projected himself as eye-witness. In examination-in-chief, he has also narrated in detail the manner in which the incident took place. However, he has specifically admitted in cross-examination in paragraph 9 that when he hid himself in the field, nobody else came there.
Further, in paragraph 28, it is his specific case that Kumar Aniruddh Singh (deceased) sustained bullet injury when he was in standing position. Further, in paragraph 31 of the cross-examination, the said witness has stated that on the date of occurrence, he did not meet Chowkidar. He has also stated that he met the informant and his family members on the date of occurrence at about 09:30-10:00 PM and at that time he informed the said persons with regard to the incident in question. 17.2. However, at this stage, it is required to be observed that PW 3, Mahesh Prasad Singh, has also projected himself as an eye-witness. However, during the cross-examination in paragraph 4, the said witness has admitted that he did not inform to the village people. He had informed about the incident to Daroga only and not to any other person of the village. He has also
Patna High Court G. APP. (DB) No.10 of 2000 dt.08-07-2025 25/32 stated that he informed to the Daroga at 06:00-07:00 AM on
14.11.1994. Further, in paragraph 17 of his cross-examination, the said witness has stated that bullet hit Kumar Aniruddh Singh when he was running. 17.3. At this stage, we would also like to discuss the deposition of PW 9 Rana Hare Ram Singh (informant), who has also projected himself as an eye-witness. The said witness in paragraph 9 has admitted that he informed the Chowkidar with regard to the incident in question. Thereafter, Chowkidar went to the police station. Thereafter, one Ram Chandra Singh (PW 4) came at the place of occurrence at 06:00 PM. The informant asked him to go to the police station at 06:00 PM. Therefore, Ram Chandra Singh also went to the police station at 06:00 PM. After returning, Ram Chandra Singh informed the informant that he had already informed to the police station with regard to the incident.
Further, PW 9 has also admitted that Chowkidar Bhagwan Das stayed at the place of occurrence for half an hour and after Bhagwan Das left the place of occurrence, Rajendra Singh (PW 1) and Mahesh Prasad Singh (PW 3) and other persons of the village came. Further, PW 9 has also admitted in paragraph 10 that after Chowkidar went from the place of occurrence, the persons who came at the said place, he did not information to the said persons
Patna High Court G. APP. (DB) No.10 of 2000 dt.08-07-2025 26/32 how the incident took place. In paragraph 23, the said witness has also admitted that when the firing took place, Rajendra Singh was running 4-5 steps ahead of deceased Kumar Aniruddh Singh towards north-east direction. 17.4. Thus, from the aforesaid deposition given by the so-called eye-witnesses, it transpires that there are major contradictions, inconsistencies and discrepancies in the deposition of the so-called eye-witnesses. One eye-witness has stated that the bullet hit the deceased Kumar Aniruddh Singh when he was in standing position, whereas another eye-witness has said that the bullet hit the deceased when he was running. Further, as per the case of the informant, PW 1 was running 4-5 steps ahead of Kumar Aniruddh Singh (deceased). Thus, it is not possible for PW 1 to see who had shot the fire. Further, as per PW 1, so-called eye- witness, the incident took place at 04:45 PM and he remained at the place of occurrence till 09:30-10:00 PM and at that time, the informant and his family members came at the said place. Thus, it can be said that the informant is not an eye-witness to the occurrence in question. Further, it is the case of the informant that he is the eye-witness to the occurrence in question and the Chowkidar Bhagwan Das came at the place of occurrence after the occurrence had taken place. The informant, therefore, narrated
Patna High Court G. APP.
(DB) No.10 of 2000 dt.08-07-2025 27/32 about the manner in which the incident took place to the Chowkidar. Informant asked Chowkidar to go to the police station and inform to the police with regard to the incident in question. It is the specific case of the informant that after the Chowkidar Bhagwan Das left the place, PW 1 and PW 3 came at the said place. We are of the view that, looking to the aforesaid major contradictions and inconsistencies in the story of the prosecution, the deposition given by the so-called eye-witnesses cannot be accepted. 17.5. At this stage, we would also like to observe that PW 10, Dr. Bipul Kumar, who had conducted the post mortem of the dead bodies of the deceased, has specifically deposed before the court that the entry wound was found on the chest of the deceased Kumar Aniruddh Singh. At this stage, we may recall that as per the case of the informant in the fard-beyan as well as as per the case of the informant in his deposition before the court, the bullet hit the deceased when he was running. Similarly, it is the case of PW 3 that the bullet hit Kumar Aniruddh Singh when he was running. We are, therefore, of the view that even the medical evidence does not support the version given by the so-called eye- witness. Patna High Court G. APP. (DB) No.10 of 2000 dt.08-07-2025 28/32
17.6. At this stage, we would also like to discuss with regard to the deposition given by PW 11, Paras Nath Singh, the Investigating Officer. In paragraph 5 of his cross-examination, the said witness has admitted that on the basis of the information given by Chowkidar Bhagwan Das on 13.11.1994, entry no. 269 came to be entered into the station diary and thereafter, as per the information given by Chowkidar, the police force rushed to the place of occurrence.
Thus, from the aforesaid deposition of the IO, it can be said that Chowkidar Bhagwan Das informed to the police with regard to the occurrence in question and, therefore, entry was made in the station diary. 17.7. At this stage, we may observe that, as per the case of the informant, he informed the Chowkidar Bhagwan Das, who came at the place of occurrence at about 06:00 PM, about the manner in which the incident took place and the informant asked him to go to the police station. Thus, Chowkidar Bhagwan Das was aware about the manner in which the incident took place, name of the deceased as well as the assailants. However, the prosecution did not produce the station diary entry before the court. What was the information given by the said Chowkidar to the police has not been brought before the court. Thus, it appears that the prosecution has suppressed the material aspect. Further,
Patna High Court G. APP. (DB) No.10 of 2000 dt.08-07-2025 29/32 the information given by the Chowkidar Bhagwan Das to the police with regard to the incident in question was required to be treated as the first information report. However, the IO thought it fit to record the fard-beyan of the informant at the place of occurrence. 17.8. Looking to the entire evidence led by the prosecution, as discussed hereinabove, we are of the view that the prosecution has failed to prove the case against the accused beyond reasonable doubt. 17.9. At this stage, we would like to refer the decision rendered by the Hon’ble Supreme Court in the case of Chandrappa and Ors. Vs. State of Karnataka, reported in (2007) 4 SCC 415. The Hon’ble Supreme Court has laid down the principle regarding the powers of the Appellate Court while dealing with an appeal against an order of acquittal. In Para-42 of the said decision, the Hon’ble Supreme Court has observed as under:-
“42.
From the above decisions, in our considered view, the following general principles regarding powers of the appellate court while dealing with an appeal against an order of acquittal emerge: (1) An appellate court has full power to review, re-appreciate and reconsider the evidence upon which the order of acquittal is founded. (2) The Code of Criminal Procedure, 1973 puts no limitation, restriction or condition on exercise of such power and an appellate court
Patna High Court G. APP. (DB) No.10 of 2000 dt.08-07-2025 30/32 on the evidence before it may reach its own conclusion, both on questions of fact and of law. (3) Various expressions, such as,
“substantial and compelling reasons”, “good and sufficient grounds”, “very strong circumstances”, “distorted conclusions”,
“glaring mistakes”, etc. are not intended to curtail extensive powers of an appellate court in an appeal against acquittal. Such phraseologies are more in the nature of
“flourishes of language” to emphasize the reluctance of an appellate court to interfere with acquittal than to curtail the power of the court to review the evidence and to come to its own conclusion. (4) An appellate court, however, must bear in mind that in case of acquittal, there is double presumption in favour of the accused. Firstly, the presumption of innocence is available to him under the fundamental principle of criminal jurisprudence that every person shall be presumed to be innocent unless he is proved guilty by a competent court of law. Secondly, the accused having secured his acquittal, the presumption of his innocence is further reinforced, reaffirmed and strengthened by the trial court. (5) If two reasonable conclusions are possible on the basis of the evidence on record, the appellate court should not disturb the finding of acquittal recorded by the trial court.”
17.10. In the case of Nikhil Chandra Mondal Vs. State of West Bengal, reported in (2023) 6 SCC 605, the Hon’ble Supreme Court has observed, in Para-22, as under:-
“22.
Recently, a three-Judge Bench of this Court in Rajesh Prasad v. State of Bihar [Rajesh Prasad v. State of Bihar, (2022) 3 SCC 471 : (2022) 2 SCC (Cri) 31] has considered various earlier judgments on the scope of interference in a case of
Patna High Court G. APP. (DB) No.10 of 2000 dt.08-07-2025 31/32 acquittal. It held that there is double presumption in favour of the accused. Firstly, the presumption of innocence that is available to him under the fundamental principle of criminal jurisprudence that every person shall be presumed to be innocent unless he is proved guilty by a competent court of law. Secondly, the accused having secured his acquittal, the presumption of his innocence is further reinforced, reaffirmed and strengthened by the court. It has been further held that if two reasonable conclusions are possible on the basis of the evidence on record, the appellate court should not disturb the finding of acquittal recorded by the trial court.”
17.11. Thus, from the aforesaid decisions rendered by the Hon’ble Supreme Court, it can be said that Appellate Court must bear in mind that in case of acquittal, there is double presumption in favour of the accused. Further, if two reasonable conclusions are possible on the basis of the evidence on record, the Appellate Court should not disturb the finding recorded by the Trial Court. CONCLUSION: -
18. Keeping in view the aforesaid decisions rendered by the Hon’ble Supreme Court, we have carefully
Patna High Court G. APP.
(DB) No.10 of 2000 dt.08-07-2025 32/32 examined the evidence led by the prosecution as well as the impugned judgment of acquittal rendered by the trial court, we are of the view that the prosecution has failed to prove the case against the accused beyond reasonable doubt and the trial court has not committed any error while passing the impugned judgment of acquittal. 19. In view of the aforesaid discussion, we are of the view that no interference is required in the impugned judgment rendered by the trial court
20. Accordingly, this appeal is dismissed. Pawan/- (Vipul M. Pancholi, J) (Sunil Dutta Mishra, J) AFR/NAFR A.F.R.
