This criminal misc. application is filed under Section 528 of B.N.S.S. by the petitioners/accused for quashing of the charge-sheet No.01/2024 dated 05.11.2024 charge-sheet No.02/2024 dated 03.01.2025, the impugned F.I.R. dated 06.08.2024 and cognizance/summoning orders dated 05.11.2024 & 07.02.2025 passed by learned court of Additional Chief Judicial Magistrate, Ramnagar, Nainital in Criminal Case No.1206 of 2024 ‘State of Uttarakhand vs. Lovepreet Singh @ Lavi & others’ and Criminal Case No.276 of 2025 ‘State of Uttarakhand vs. Rajesh Goyal and another’ as well as the entire proceedings of Sessions Trial No.12 of 2024 ‘State of Uttarakhand vs. Lovepreet Singh & Others’ pending in the court of learned Additional Session Judge, Ramnagar, District Nainital and Criminal Case No. 276 of 1 2025:UHC:4466 2025 ‘State of Uttarakhand vs. Rajesh Goyal & Another’ for the offence punishable under Sections 109, 190, 191(2), 191(3), 117 & 61 of B.N.S., P.S. Ramnagar, District Nainital qua the petitioners/accused, in view of the compromise arrived at between the parties. 2. In view of the fact that a Compounding Application (IA No. 01 of 2025) was filed by the parties before this Court, this Court vide order dated 27.03.2025 had directed the parties to appear before the Secretary, District Legal Services Authority, District Nainital in order to get their statements recorded and to verify the compromise deed. 3. Pursuant to such order, the Secretary, District Legal Services Authority, District Nainital has submitted the report dated 02.04.2025 which clearly indicates that the parties have settled the dispute amicably and have also verified the contents of the compromise. 4. In view of the above, Compounding Application (IA No.01 of 2025) is allowed. As a consequence thereof, the charge-sheet No.01/2024 dated 05.11.2024 charge- sheet No.02/2024 dated 03.01.2025, the impugned F.I.R. dated 06.08.2024 and cognizance/summoning orders dated 05.11.2024 & 07.02.2025 passed by learned court of Additional Chief Judicial Magistrate, Ramnagar, 2 2025:UHC:4466 Nainital in Criminal Case No.1206 of 2024 ‘State of Uttarakhand vs. Lovepreet Singh @ Lavi & others’ and Criminal Case No.276 of 2025 ‘State of Uttarakhand vs. Rajesh Goyal and another’ as well as the entire proceedings of Sessions Trial No.12 of 2024 ‘State of Uttarakhand vs. Lovepreet Singh & Others’ pending in the court of learned Additional Session Judge, Ramnagar, District Nainital and Criminal Case No. 276 of 2025 ‘State of Uttarakhand vs. Rajesh Goyal & Another’ for the offence punishable under Sections 109, 190, 191(2), 191(3), 117 & 61 of B.N.S., P.S. Ramnagar, District Nainital are hereby quashed qua the petitioners. 5. Present petition u/s 528 of B.N.S.S. is, thus, disposed of in terms of the compromise arrived at between the parties.
