The present appeal has been filed by the appellant assailing the order dated 23.04.2009 passed upon the temporary injunction application No.37/2008, whereby the temporary injunction application filed by the plaintiff-respondent was partly allowed by the Court of Additional District Judge (Fast Track) No.6, Jaipur City, Jaipur. 2. From the record of the case, it reveals that the operation of the impugned order was stayed by this Court on 18.05.2009 and the same was duly confirmed vide order dated 16.09.2013. 3. During the course of hearing of the present appeal, it transpired that the original suit filed by the plaintiff-respondent was dismissed on 03.08.2011, therefore, the present appeal is dismissed as having become infructuous. 4.
