Heard the submissions of the learned counsel for the petitioners and the learned Assistant Public Prosecutor appearing for the State. 2. The petitionerswas arraigned as A.1 to A.6 in Crime No.48 of 2025 of Ongole I Town Police Station, Ongole, Prakasam District, registered for the alleged offences under Sections 85 of the Bharatiya Nyaya Sanhita 2023 and Sections 3 and 4 of the Dowry Prohibition Act, 1961, on the complaint of the 2'^'^ respondent. 3. The learned counsel for the petitioners submits that the petitioners have been arraigned as accused in the present criminal proceedings solely on account of matrimonial disputes. However, the petitioners and the 2"‘^respondent have amicably resolved their disputes and have entered into a Memorandum of Compromise dated 17.01.2025. In pursuance of the said compromise, the 2"*^ respondent has retrieved all her personal belongings from the residence of A.1, as duly acknowledged in the Memorandum of Compromise, and has undertaken to withdraw all criminal proceedings initiated against the petitioners. Despite such an undertaking, the 2'^‘^respondent has failed to withdraw the present criminal case. 4. The veracity of the allegations made in the complaint would come to light during the course of the investigation. At thjgrjU(;icture , the Court is ipi^ CRLP. No.4834 of 20^^ \ not inclined to interfere in the investigation. Furthermore, the offences alleged against the petitioners would attract a punishment of less than seven years. Therefore, the Station House Officer, Ongole I Town Police Station, Prakasam District, is directed to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 insofar as the petitioners are concerned, for the purpose of investigation in connection with Crime No.48 of 2025. This order would not preclude the investigation officer from filing a charge sheet or final report after completion of the investigation. Accordingly, the criminal petition is disposed of.
