IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH 215 RSA No. 205 of 2001 (O&M) DECIDED ON: 21st July, 2025 Amar Singh and another .....APPELLANTS Versus Rattan Singh .....RESPONDENT CORAM: HON'BLE MS. JUSTICE NIDHI GUPTA. Present: Mr. Parul Saini, Advocate for Mr. Pritam Singh Saini, Advocate for appellants. *** NIDHI GUPTA. , J (ORAL) None had appeared on behalf of appellants for the last two dates of hearing. Accordingly on the last date of hearing i.e. 24.01.2025 fresh notice was ordered to be issued to appellants as well as respondent. 2. As per office report, appellants No. 1 and 2 have died and respondent No.1 has also died. 3. Today learned counsel appearing on behalf of appellants reiterates her submission made on 31.08.2024 that she no longer has the file or instructions in the matter. 4. In the aforesaid premise, issuance of fresh notice to appellants would be a futile exercise. It appears that due to sheer long pendency of the present second appeal before this Court for a period of more than 24 years, the appellants or their LRs have lost interest in pursuing the same, as no attempt has been made by them to contact their counsel or to engage a new counsel. REEMA SAINI 2025.07.22 17:07 I attest to the accuracy and integrity of this document High Court, Chandigarh RSA No. 205 of 2001 (O&M) -2- 5. Be that as it may, in view of the foregoing circumstances, the instant regular second appeal is dismissed for non-prosecution, with liberty to the LRs of the deceased-appellants, if any, to move an appropriate application within a period of 02 months from today for reviving the same, if so, advised. 6. Pending application(s), if any, shall stands disposed of.
