Note NO.48022/238/FMU-WR.II/2017, dated 29.06.2017, and the consequential action of the 5*^ respondent in deducting labour cess from the running bills related to the work covered under Agreement No.17/2017-18 dated 12.01.2018, as being illegal and contrary to law. 2. 2. The case of the petitioner is that he participated in the tender notification issued by the 4*^ respondent for the work of providing the Kavali Water Supply Improvement Scheme, which includes source and performance-based Operation and Maintenance (O&M) for seven years, including a defect liability period of two years, under the AMRUT project. The petitioner was the successful bidder, executed the contract, and had completed approximately 35% of the work at the time of filing this writ th petition. While releasing running bills, the 5 respondent deducted labour cess under the above-referred agreement. Aggrieved by such deduction, the present writ petition has been filed. 3 Learned counsel for the petitioner has also drawn the attention of this Court to a recent Judgment rendered by this 3. Court in Ch. Murali Mohan Rao v. State of Andhra Pradesh, represented by its Principal Secretary and others, vide common order dated 20.09.2023 in W.P. No.16156 of 2020 and batch wherein the writ petitions seeking similar relief were allowed. Learned Assistant Government Pleader does not dispute 4. the applicability of the said decision to the present case. In view of the same, this writ petition is allowed in terms of 5. the directions issued in CH.V.V. Subba Rao v. Government of Andhra Pradesh, represented by its Principal Secretary and others (W.P. No.11269 of 2009 & batch, dated 22.10.2009), and in Ch. Murali Mohan Rao v. State of Andhra Pradesh, represented by its Principal Secretary and Others (W.P.
